MONACO AUTO — TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Monaco Auto website, services, and purchase of products from Monaco Auto (“Monaco Auto,” “we,” “us,” or “our”).

By accessing our website, placing an order, purchasing a product, submitting payment, or otherwise conducting a transaction with Monaco Auto, you agree to these Terms.

If you do not agree with these Terms, do not purchase or use our products or services.

Nothing in these Terms limits any rights or remedies that cannot legally be limited or excluded under applicable law.

1. AFTERMARKET AUTOMOTIVE PRODUCTS

Monaco Auto sells aftermarket automotive products and accessories.

Unless expressly stated otherwise, products sold by Monaco Auto are not original equipment manufacturer (“OEM”) parts and are not manufactured, sponsored, approved, endorsed, or warranted by the vehicle manufacturer.

References to vehicle manufacturers, model names, chassis codes, trim levels, or trademarks are used solely to identify compatibility or intended application.

Aftermarket components may differ from OEM components in dimensions, finish, construction, mounting method, flexibility, surface quality, or other characteristics.

Some products may require professional preparation, adjustment, drilling, trimming, sanding, heating, modification, additional hardware, or other work to achieve proper installation.

2. VEHICLE FITMENT

Product descriptions identify the vehicle applications for which a product is intended based on information reasonably available to Monaco Auto.

However, vehicles can vary based on:

  • model year;
  • trim level;
  • factory options;
  • bumper or body style;
  • facelift or pre-facelift configuration;
  • regional specifications;
  • previous accident repairs;
  • aftermarket modifications;
  • previously replaced body panels;
  • non-OEM components; and
  • manufacturing tolerances.

The customer is responsible for confirming that the product ordered is appropriate for their specific vehicle before purchase and before installation.

When Monaco Auto requests photographs, a VIN, model year, trim level, bumper photographs, measurements, or other information to assist with fitment, the customer is responsible for providing complete and accurate information.

Any fitment recommendation made using inaccurate, incomplete, misleading, or omitted vehicle information supplied by the customer does not make Monaco Auto responsible for an otherwise correctly supplied product.

A customer’s assumption that a product fits their vehicle is not a representation by Monaco Auto that the product is compatible.

3. TEST-FITTING BEFORE INSTALLATION

All body parts and exterior accessories should be test-fitted before permanent installation, modification, painting, wrapping, drilling, cutting, sanding, bonding, or application of adhesive.

Customers and installers are responsible for inspecting the product and confirming acceptable fitment before performing irreversible work.

Unless otherwise required by law, Monaco Auto may refuse a return or fitment claim where a product has been:

  • drilled;
  • cut;
  • trimmed;
  • sanded;
  • painted;
  • wrapped;
  • permanently bonded;
  • modified;
  • damaged during installation; or
  • otherwise materially altered from the condition in which it was supplied.

Customers should immediately stop installation and contact Monaco Auto if they reasonably believe that they received an incorrect or defective product.

4. PROFESSIONAL INSTALLATION

Monaco Auto strongly recommends professional installation of aftermarket automotive components.

Installation is performed entirely independently from Monaco Auto unless Monaco Auto expressly agrees in writing to provide installation services.

Where installation is performed by the customer or a third-party installer, Monaco Auto is not responsible for the installer’s workmanship, methods, labour charges, mistakes, damage, or representations.

A third-party installer’s statement that a product “does not fit” does not by itself establish that the product is defective or incorrectly supplied.

Monaco Auto may request photographs, measurements, videos, part numbers, packaging information, or other reasonable evidence before evaluating a fitment claim.

5. INSTALLATION COSTS AND CONSEQUENTIAL EXPENSES

To the maximum extent permitted by applicable law, Monaco Auto is not responsible for third-party expenses resulting from the installation, removal, diagnosis, adjustment, modification, painting, wrapping, repair, storage, towing, vehicle downtime, rental vehicle use, or reinstallation of a product.

Customers are responsible for inspecting and test-fitting products before incurring significant third-party labour or finishing expenses.

Monaco Auto does not authorize third-party labour or repair expenses unless Monaco Auto expressly agrees to those expenses in writing beforehand.

6. PRODUCT APPEARANCE AND VARIATION

Product photographs are intended to reasonably represent the product but may not perfectly represent every unit.

Appearance may vary because of lighting, photography, screen calibration, manufacturing batches, materials, weave patterns, surface reflections, production tolerances, and other factors.

Minor cosmetic or dimensional variation inherent to aftermarket manufacturing does not necessarily indicate that a product is defective.

7. CARBON-FIBRE PRODUCTS

Carbon-fibre and carbon-fibre-style components may contain natural visual variations.

These can include reasonable variation in:

  • weave alignment;
  • weave positioning;
  • pattern symmetry;
  • resin appearance;
  • clear-coat appearance;
  • surface texture;
  • reflections; and
  • minor manufacturing characteristics.

Customers purchasing carbon-fibre products acknowledge that individual units may not be visually identical to website photographs.

This section does not exclude rights relating to products that are materially defective, materially misdescribed, or otherwise protected by applicable law.

8. PRODUCT IMAGES

Some website photographs may include vehicles, wheels, accessories, trim, hardware, or other items for illustrative purposes.

Only the product specifically identified in the applicable product listing is included in the purchase unless expressly stated otherwise.

Lifestyle photographs or installed photographs are examples of how a product may appear and are not guarantees that every vehicle will produce an identical appearance.

9. PRICING

Prices may change at any time without notice before an order is accepted.

Prices displayed on the website may exclude applicable taxes, shipping charges, duties, installation, or other charges unless specifically stated otherwise.

Monaco Auto reserves the right to correct genuine typographical, technical, inventory, or pricing errors, subject to applicable law.

If a material pricing error is identified before fulfilment, Monaco Auto may contact the customer and, where legally permitted, offer the customer the choice of proceeding at the corrected price or cancelling the order for a refund.

10. ORDER ACCEPTANCE

Submission of an order does not necessarily constitute final acceptance of that order.

Monaco Auto may, subject to applicable law, refuse or cancel an order for legitimate reasons including:

  • suspected fraud;
  • payment failure;
  • inventory errors;
  • duplicate orders;
  • obvious pricing errors;
  • inability to deliver the product;
  • incorrect product information; or
  • suspected unauthorized resale or commercial misuse.

If Monaco Auto cancels a paid order before fulfilment, amounts paid for the cancelled products will be refunded as required by law.

11. INVENTORY

Inventory information is maintained as accurately as reasonably possible but errors may occasionally occur.

A product appearing as available online does not guarantee physical availability until the order has been processed and accepted.

If an ordered item becomes unavailable, Monaco Auto may offer a replacement, backorder, store credit, or refund, where appropriate and subject to the customer’s applicable legal rights.

12. SHIPPING

Shipping and delivery dates are estimates unless Monaco Auto expressly guarantees a particular date in writing.

Monaco Auto is not responsible for delays caused by circumstances reasonably outside its control, including carrier delays, weather, customs, transportation disruptions, incorrect addresses supplied by customers, or other external events.

Customers are responsible for providing an accurate and complete delivery address.

Additional costs caused by an incorrect or incomplete address supplied by the customer may be charged to the customer where permitted by law.

13. SHIPPING DAMAGE

Customers should inspect shipments as soon as reasonably possible after delivery.

Visible shipping damage should be photographed before installation and, where practical, before the product is fully removed from its packaging.

Customers making a shipping-damage claim may be required to provide:

  • photographs of the shipping box;
  • photographs of shipping labels;
  • photographs of packaging;
  • photographs or video of the damaged product; and
  • any information reasonably required for a carrier claim.

Customers should retain the original packaging until the claim has been resolved.

Disposing of packaging or materially altering the product may limit Monaco Auto’s ability to pursue a carrier claim, although nothing in this section removes rights that cannot legally be excluded.

14. RETURNS

Unless a product listing or separate Return Policy states otherwise, discretionary returns of correctly supplied, non-defective products require prior approval from Monaco Auto.

Approved discretionary returns must generally be:

  • unused;
  • uninstalled;
  • unmodified;
  • undamaged;
  • in resalable condition; and
  • accompanied by the original packaging where reasonably possible.

Original shipping charges are generally non-refundable for discretionary returns.

Customers are responsible for return shipping for discretionary returns unless Monaco Auto agrees otherwise.

Monaco Auto may refuse discretionary returns of specially ordered, custom, clearance, final-sale, installed, modified, painted, wrapped, drilled, cut, damaged, or otherwise non-resalable products, subject to applicable law.

Nothing in this section restricts return, refund, cancellation, warranty, or other rights provided by applicable consumer protection law.

15. ORDERING THE WRONG PRODUCT

If Monaco Auto supplied the product that the customer ordered, but the customer selected the wrong model, trim, year, bumper configuration, body style, or other application, the situation will generally be treated as a discretionary return rather than a Monaco Auto fulfilment error.

The customer may be responsible for return shipping and other reasonable costs associated with exchanging the product.

16. INCORRECT PRODUCTS

If Monaco Auto ships a materially different product from the product ordered, the customer should contact Monaco Auto promptly.

Monaco Auto may require reasonable evidence of the incorrect item.

Where Monaco Auto confirms a fulfilment error, Monaco Auto will provide an appropriate remedy consistent with applicable law.

17. DEFECTIVE PRODUCTS

Claims concerning alleged manufacturing defects will be evaluated based on the nature of the product, evidence provided, condition of the product, installation status, and applicable legal requirements.

Monaco Auto may require photographs, videos, measurements, installation information, or return of the product before determining an appropriate remedy.

Damage caused by incorrect installation, accidents, impacts, misuse, neglect, modification, racing, improper storage, environmental exposure beyond reasonable product expectations, or ordinary wear and tear is not considered a manufacturing defect.

18. REFUNDS

Approved refunds will normally be returned to the original payment method where reasonably possible.

Processing times may vary depending on the customer’s financial institution or payment processor.

A refund is not considered delayed solely because a bank or payment processor requires additional processing time after Monaco Auto has submitted the refund.

19. CHARGEBACKS AND PAYMENT DISPUTES

Customers are encouraged to contact Monaco Auto regarding legitimate order concerns before initiating a payment dispute so that Monaco Auto has an opportunity to investigate and resolve the issue.

Monaco Auto reserves the right to provide payment processors, financial institutions, or dispute-resolution providers with relevant transaction records when responding to a chargeback or payment dispute, including order information, tracking information, delivery confirmation, customer communications, product information, and other relevant evidence.

Nothing in this section prevents a customer from exercising lawful rights available through their payment provider.

20. RESALE AND COMMERCIAL CUSTOMERS

Unless expressly agreed otherwise in writing, Monaco Auto products are sold for the purchaser’s own use.

Persons purchasing products for resale, commercial installation, redistribution, or other business purposes are responsible for determining their own obligations to their customers.

Monaco Auto is not responsible for promises, warranties, installation commitments, or representations independently made by a reseller or installer to another person.

21. VEHICLE MODIFICATION AND LEGAL COMPLIANCE

Customers are responsible for determining whether a modification is legal and appropriate for their vehicle and intended use.

Vehicle equipment laws, inspection requirements, insurance requirements, and road-use rules may vary by jurisdiction.

Monaco Auto does not represent that every product sold is legal for street use in every jurisdiction.

Products marketed or commonly used for off-road, show, track, or competition applications remain subject to the customer’s responsibility to comply with applicable law.

22. VEHICLE SAFETY

Customers are responsible for ensuring that installation of a product does not interfere with vehicle safety systems or safe operation.

Extra care should be taken around components involving or located near:

  • airbags;
  • crash structures;
  • parking sensors;
  • radar systems;
  • cameras;
  • ADAS equipment;
  • cooling systems;
  • lighting;
  • wheels or suspension; and
  • other safety-related equipment.

Professional installation and calibration should be obtained where appropriate.

23. ASSUMPTION OF RISK

Automotive modification inherently involves risks.

To the maximum extent permitted by law, the customer assumes responsibility for risks arising from the customer’s selection, installation, modification, use, or misuse of aftermarket products.

The customer is responsible for ensuring that the vehicle remains safe and roadworthy after modification.

24. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Monaco Auto will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the purchase, installation, use, inability to use, or removal of a product.

This may include, where legally permitted:

  • loss of vehicle use;
  • lost profits or revenue;
  • lost business opportunities;
  • towing expenses;
  • storage expenses;
  • rental vehicle expenses;
  • third-party labour;
  • diagnostic charges; and
  • loss resulting from improper installation or modification.

Where liability cannot lawfully be excluded, nothing in these Terms excludes or restricts that liability beyond what applicable law permits.

25. WARRANTIES

Any express Monaco Auto warranty applies only according to the written terms of that warranty.

No statement by an employee, contractor, installer, social-media account, marketplace listing, or other representative creates an additional warranty unless Monaco Auto expressly confirms it as a warranty.

Nothing in these Terms excludes statutory conditions, warranties, guarantees, remedies, or other consumer rights that cannot legally be excluded or restricted.

26. CUSTOMER COMMUNICATIONS

Customers are responsible for reviewing order confirmations and communications from Monaco Auto and notifying Monaco Auto of material errors as soon as reasonably possible.

Records of communications relating to orders may be retained where reasonably necessary for customer service, fraud prevention, legal compliance, warranty administration, or dispute resolution.

Personal information will be handled in accordance with Monaco Auto’s Privacy Policy and applicable privacy law.

27. FRAUD AND ABUSE

Monaco Auto may refuse future transactions, restrict service, or take other lawful measures where there is reasonable evidence of:

  • payment fraud;
  • return fraud;
  • deliberate chargeback abuse;
  • falsified damage claims;
  • materially false information;
  • threats or harassment;
  • attempted theft; or
  • other unlawful conduct.

Nothing in this section limits lawful consumer complaints or legitimate exercise of consumer rights.

28. INTELLECTUAL PROPERTY

Unless otherwise stated, Monaco Auto’s original website content, branding, logos, graphics, product photography, written descriptions, and other original materials are owned by or licensed to Monaco Auto.

They may not be commercially reproduced, copied, distributed, or used to falsely represent another business as Monaco Auto without permission, except where otherwise permitted by law.

Vehicle manufacturer names and trademarks belong to their respective owners.

29. THIRD-PARTY SERVICES

The website may use or link to third-party services including payment processors, shipping carriers, social-media platforms, analytics providers, and e-commerce infrastructure.

Monaco Auto is not responsible for independent third-party services beyond the extent required by applicable law.

Use of those services may also be subject to the applicable third party’s terms and policies.

30. PRIVACY

Personal information may be collected and used as reasonably necessary to process transactions, deliver orders, communicate with customers, prevent fraud, administer returns or warranties, maintain business records, improve services, and comply with legal obligations.

Further details should be provided in Monaco Auto’s separate Privacy Policy.

31. FORCE MAJEURE

To the maximum extent permitted by law, Monaco Auto will not be responsible for a delay or failure caused by events reasonably beyond its control, including natural disasters, severe weather, fires, floods, labour disruptions, transportation disruptions, carrier failures, customs delays, government actions, supplier disruptions, war, civil unrest, infrastructure failures, or similar events.

32. INDEMNIFICATION

To the extent permitted by applicable law, a person using Monaco Auto products for commercial resale or installation agrees to indemnify Monaco Auto against third-party claims arising directly from that person’s unauthorized representations, negligent installation, unlawful use, or material modification of the product.

This provision does not require a consumer to indemnify Monaco Auto for Monaco Auto’s own negligence, breach of contract, violation of law, or other liability that cannot legally be transferred.

33. GOVERNING LAW

These Terms and transactions with Monaco Auto are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to any mandatory consumer rights concerning jurisdiction or venue, disputes will be determined by courts of competent jurisdiction in Ontario.

34. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.

35. NO WAIVER

Failure by Monaco Auto to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or any other right.

36. CHANGES TO THESE TERMS

Monaco Auto may update these Terms periodically.

Changes apply prospectively from the effective date displayed with the updated Terms unless otherwise permitted by law.

The Terms applicable to an order will generally be the Terms in effect when the transaction was entered into, subject to applicable law.

37. ENTIRE AGREEMENT

These Terms, together with applicable product descriptions, order information, Monaco Auto’s Return Policy, Privacy Policy, and any other policies expressly incorporated into the transaction, form the agreement between Monaco Auto and the customer concerning the transaction.

Where another written Monaco Auto policy conflicts with these Terms, the more specific provision governing the particular transaction will apply, subject to applicable law.

BY PLACING AN ORDER WITH MONACO AUTO, THE CUSTOMER ACKNOWLEDGES THAT THEY HAVE READ AND AGREED TO THESE TERMS, SUBJECT TO ALL RIGHTS AND PROTECTIONS PROVIDED BY APPLICABLE LAW.
